General License Information:

Business Licenses

The Town of Silverthorne has licensing requirements for all business conducted within its corporate limits. A regular Business License is required for all businesses located in Town as well as businesses not physically located within the Town limits, but which send employees into the Town to sell, repair, or deliver merchandise and/or provide services to residents. It also extends to businesses operating on a year-round basis, a seasonal basis, or from a home.  However, if a home is being operated as a Short Term Rental, a Short Term Rental license is required in place of a regular Business License (see below). In an effort to maintain the residential character of Silverthorne's neighborhoods, businesses operating from homes within the Town (known as home occupations) require completion of the Supplemental Business License Regulations for Home Occupations and a review process by the Community Development Department. Some business categories need to provide additional information; such as proof of liability insurance.

Definitions And Specific Licensing Information:

Business: Includes all types of locations, occupations, professions, enterprises, establishments and all other kinds of activities and matters, together with all devices, machines, vehicles and other appurtenances used therein, any of which are conducted for profit or pecuniary benefit, either directly or indirectly, on any premises at a permanent location in the Town or anywhere else within its jurisdiction. Business shall not include the trade of a peddler or solicitor, as defined in the Town Code.

Exempt Activities: No license shall be required for any temporary public exhibitions or entertainment, the proceeds of which are to be devoted exclusively to religious, education, political or governmental agencies, wholesalers or businesses delivering purchased goods or services in person or through special delivery mail as the result of sales, contracts or agreements originated by Town citizens, businesses, firms, companies or organizations.

Requirements For Business Licenses:

A general business license shall be required at any establishment operating as a single enterprise. Separate general business licenses shall be required for each location of an enterprise operating at more than one location within the Town limits. A general business license is required for anyone conducting business within the Town limits regardless of the physical location of the business enterprise. Business licenses are nontransferable with a change of ownership or change of location.

Posting And Exhibiting: Every license granted shall be posted in a conspicuous place at the business location for the full term of the license. Licenses shall be removed upon expiration. It shall be the duty of each person, or a designated representative or agent, to whom a license has been issued to show the same at any proper time when requested to do so by and Town official.

Renewal: Licenses expire on December 31 shall be renewed and fees paid annually by January 31. A late fee of $10.00 a month shall be assessed for renewals completed after January 31.
License fees are not transferable to new ownership.

Short-Term Rental Licensing

The Town of Silverthorne adopted an ordinance on October 24, 2018 regulating Short Term Rentals (STR’s) within Town limits.   STR’s have become topical in resort communities in recent years due to the prevalence of related websites (Airbnb, VRBO, HomeAway, and others) and the associated community impacts.  A valid Short-Term Rental License is required for each Short Term Rental property in the Town of Silverthorne.  A short-term rental property is defined as “a residential dwelling unit, or any room therein, available for lease for a term of less than thirty (30) consecutive days.”  The license is required regardless of how the properties are marketed (through a management company, on-line through websites such as VRBO and Airbnb, newspaper ads, word of mouth, etc.).

Deed-restricted properties are prohibited from being rented on a short term basis.  Individual homeowner associations may have additional requirements, restrictions, and covenants related to short-term rentals.  If the Short Term Rental Property is part of a duplex, the owner of the adjoining unit is required to be provided written notice seven (7) days prior to filing an application. 

Short – term rental licenses are non-transferable/non-refundable in event of property sale.  The license number must be displayed in all advertising for the property. 

Occupancy – The maximum occupancy for a property is 2 people per bedroom plus 2 people.  All reservations and advertising needs to comply with the maximum occupancy for the property.  The number of bedrooms for a property is determined by the Summit County Assessor’s Office.
